BY THE NUMBERS: THE SUNTAN TAX: FIRST TAX INCREASE IN THE NEW HEALTHCARE LAW
The tanning tax was added very late to the healthcare bill without any analysis of how it would
affect the indoor tanning industry, comprised primarily of small businesses. The new tax
amounts to a 10 percent increase in the cost of doing business, making it even harder to keep
customers coming through the doors of these “mom and pop” businesses in this difficult
economy. This is just the first of countless new taxes contained in the new healthcare law, which
the NFIB is challenging as unconstitutional.

FIRST TAX INCREASE IN NEW HEALTHCARE LAW TAKES EFFECT TOMORROW
The first tax in the new healthcare law will go into effect July 1 and it falls on the backs of the very people who can least afford it – our nation’s small businesses.
The tax, known as the “tanning tax,” levies a 10 percent tax on tanning services and is predicted to raise $2.7 billion (over 10 years). The revenue raiser will fall disproportionately on “mom and pop” small businesses, typically owned and operated by women, and is designed to pay for the nearly $1 trillion healthcare law.

POSITION OF THE INDOOR TANNING ASSOCIATION REGARDING THE 10% TAX ON TANNING SERVICES
The ten-percent tax on tanning services included in the recently passed healthcare legislation is a regressive tax that would unfairly hit working women and college students who comprise the majority of indoor tanning consumers. This tax directly violates President Obama’s pledge not to raise taxes on the middle class.

RESPONSE TO INQUIRY ABOUT MELANOMA STUDY PUBLISHED IN AMERICAN ASSOCIATION FOR CANCER
The latest science is contradictory. A study out just two weeks ago from the MD Anderson Cancer Center found that UVA light does not cause melanoma.i
Another study out this week claims that most sunscreens could actually promote the growth of skin cancers because they contain Vitamin A.ii

3-25 FDA MEETING RELEASE
An advisory panel to the Food and Drug Administration today recommended that the agency consider additional regulations on indoor tanning, despite testimony from the Indoor Tanning Association (ITA) that existing regulations in the U.S. – already the most stringent in the world – are sufficient and that additional oversight would be excessive, unjustifiable and could significantly damage the entire industry
